Preamble

You are deemed to be aware of and have accepted these general terms of sale before you place your order.

For international sales, you should contact us beforehand so that we can outline any conditions that apply to your planned order. Taxes, delivery charges and any extras, in addition to the standards applicable to our products, may differ from regulations applicable in France.

 

1- Order

The contract is drawn up following receipt of your order and full payment of the sales price, applicable taxes, delivery charges and any other extras.

You will be made aware of the total amount of applicable taxes, delivery costs and any extras before placing your order.

 

2- Delivery

Upon delivery, you must check that the goods delivered correspond to your order.

 

3- Transport

You are responsible for all transport operations, insurance and handling costs.

You are responsible for the risk of loss or damage to goods throughout these operations if you have chosen a carrier other than the one offered by us. In such cases, you must, if necessary, pursue any action against the carrier, even if the goods were sent free of charge.

 

4- Delivery time

 

Goods are delivered within a maximum of two months as from the date of your order, subject to payment of the price and any extras.

This period shall be increased in the event of strikes or if delivery is impossible due to bad weather conditions. We will inform you if either of these situations occurs. We will then specify a new delivery time.

In any event, legal provisions shall be enforced if goods are not delivered on the agreed date.

5- Price

 

The prices of our goods are displayed on our website. Additional preparation and delivery fees will be added to these prices.

Current VAT rates will also be added to these prices, as will Waste Electrical and Electronic Equipment (WEEE) eco-contributions.

In the event of a VAT increase or reduction, and subject to any legal provisions, prices including taxes will be increased or reduced accordingly.

For international sales, all related taxes or charges are borne by the customer.

 

6- Payment

Payment of prices and extras must be made upfront when placing your order.

 

7- Guarantees

Our products are sold with the legal guarantee of conformity as outlined in article L211-4 of the French Code of Consumption, as well as the hidden defects warranty for the product sold as stipulated in Articles 1641 et seq. of the French Civil Code.

In terms of the legal guarantee of conformity, the consumer:

- is granted a two-year period from delivery of goods in which to act,

- may decide whether to have the goods repaired or replaced, subject to cost as outlined in Article L211-9 of the French Code of Consumption,

- is not required to provide evidence of the product's lack of conformity within the two years following delivery of the goods.

The legal guarantee of conformity applies irrespective of the commercial warranty that may be awarded.

The consumer may decide to use the warranty against hidden defects in the product sold as stipulated in Articles 1641 et seq. of the French Civil Code. In these circumstances, the consumer may choose between cancellation of the sale or a reduction in sale price pursuant to Article 1644 of the French Civil Code.

 

8- Right to Withdrawal

You have the right to withdraw from the contract without giving any reason within 14 days. The withdrawal period expires 14 days after you or a third party designated by you, not including the carrier, physically takes possession of the goods.

To exercise your right to withdrawal, you should notify us of your decision to withdraw from the contract with a clearly worded statement (for example, a letter sent by post, fax or e-mail) to the KRAMPOUZ company head office: PLUGUFFAN (29700) - rue de Bel Air - Fax: +33 2 98 53 92 93 - E-mail address: contact@krampouz.com. You may use the template form provided at the bottom of these general terms of sale, but it is not compulsory.

To ensure that the withdrawal period is respected, simply send your withdrawal statement before expiry of the withdrawal period.

In the event that you withdraw your contract, we will refund all payments received, including delivery costs (excluding additional charges resulting from your choice to use an alternative delivery method instead of the cheapest standard delivery method offered by us). The refund will be made without undue delay and within 14 days after you inform us of your decision. The refund will be made using the same payment method used for the initial transaction, unless you specifically request a different method; in any case, you will not be charged for this refund.

You should return the goods to us without undue delay and within 2 weeks of informing us of your decision to withdraw from the contract. This deadline is deemed to have been respected if you return the goods within 14 days. You will be responsible for the direct cost of returning the goods.

You will only be held liable if there is damage to the goods resulting from handling that is not necessary for establishing the nature, features and good working order of the goods.

9- Intellectual Property

All patents, designs and models, knowledge, information, specifications, concepts (ideas or strategies, methodologies etc.), documents, objects (models, samples, examples etc.) that we use or convey while selling our products, remain the exclusive property of our company or its providers.

You may only use industrial and intellectual property rights belonging to our company or its providers after signing a licence agreement, even if usage rights have been granted free of charge.

 

10- Waste Electrical and Electronic Equipment Directive (WEEE)

In accordance with the French Environment Code and in the absence of any agreement to the contrary, we are responsible for organising and financing the application of professional WEEE directives imposed on the market, after you have sent, at your own expense and risk, the equipment and components provided for in this article.

In order to ensure that these directives are applied, you undertake to refer to the terms and conditions for reception and use of the products, which may be found at the following:

You provide guarantees for all consequences related to failure to respect the obligations stipulated in this article. We will not, under any circumstances or for any reason whatsoever, be held liable for your failure to comply with the obligations outlined in this article.

 

11- Disputes

The applicable law is French law.

We inform you of the possibility to launch a conventional mediation procedure, at your request, in the event of a dispute, in application of Articles 1532 et seq. of the French Code of Civil Procedure. If conventional mediation methods fail, any dispute, whatever the nature, cause or subject, shall be brought exclusively before the court with jurisdiction.

2- Delivery

Upon delivery, you must check that the goods delivered correspond to your order.

You must inform us immediately of any lack of conformity or visible defects. Any misgivings must be noted on the carrier receipt. If you fail to do this, you will be irrefutably deemed to have accepted the merchandise in its current state.

 

3- Transport

You are responsible for all costs, risk and damages related to transport operations, insurance and handling. If required, you must exercise any remedial recourse against the carrier even if the goods were sent free of charge.

 

4- Delivery time

Goods are delivered within a maximum of two months as from the date of your order, subject to payment of the price and any extras.

This period shall be increased in the event of strikes or if delivery is impossible due to bad weather conditions. We will inform you if either of these situations occurs. We will then specify a new delivery time.

In any event, there are no grounds to automatically terminate the contract or to grant the payment of damages if delivery is not made on the agreed date.

 

5- Price

The prices of our goods are clearly indicated on our website. Additional preparation and delivery fees will be added to these prices.

Current VAT rates will be added to these prices. In the event of a VAT increase or reduction, and subject to any legal provisions, prices including taxes will be increased or reduced accordingly.

Unless specifically stated, our prices do not include delivery charges which must consequently be added.

For international sales, all related taxes or charges required for this operation are borne by the customer.

 

6- Payment

Payment of prices and extras must be made upfront when placing your order.

 

7- Guarantees

No warranty applies if in reality, supposed faults with the product are the result of:

-          damage or accidents resulting from improper supervision or maintenance of products sold,

-          an error in connecting the product to a power supply, which is never carried out by our company,

-          improper or excessive use of products sold,

-          any other external cause of damage to the products sold.

Any guarantee is rendered void if the products sold are modified or used improperly.

Replacing products during the warranty period does not extend the guarantee period.

Routine maintenance of products sold is not included in the guarantee(s).

 

8- Limit of Liability

We undertake to replace faulty or defective parts for free during the [12]-month warranty period dating from receipt of goods. Delivery and return of items will however be at your own expense.

Subject to any guarantees provided for by law, our responsibility is strictly limited for all causes to:

-          direct loss and material loss caused to the buyer, excluding indirect and economic loss (operating loss, loss of clients or orders, commercial problems, etc.), notwithstanding the fact that we may have be warned of the possibility of such damages;

-          a maximum sum totalling [3,000,000] Euros, except in the event of gross negligence or physical injury.

You waive the right, both on behalf of yourself and your insurers, to institute proceedings against us and our insurers, in the form of compensation exceeding the limits defined above.

11- Disputes

Any dispute related to the formation, interpretation or enforcement of these terms which parties are unable to resolve amicably shall in the first instance be submitted to the exclusive jurisdiction of the QUIMPER Commercial Court, in the event of summary procedures, introduction of third parties, multiple instances or parties or interlocutory claims.
